Q. - Do stamp paper is needed for service agreement ?

A.- Yes, you must use a `Rs 100 stamp paper. The first page of the service agreement, provided to you with the joining letter, should be typed on the Rs`100 stamp paper. You can attach the remaining pages as it is to the stamp paper. In case of non availability of Rs`100 stamp paper, you can use two stamp papers of `Rs 50 or you can opt for e stamping/Franking - Impression of Stamps. Remember that you can't just type it on a simple paper.


Q.- Editing the content of service agreement ?

A. Print the service agreement as
given in the campus commune portal without any changes i.e. copy and paste it carefully. Do not change anything not even a comma or full stop. And also don't delete anything. You can't even rearrange the clauses and if you do then it won't be valid anymore.


Q.- In whose name stamp paper should be purchased ?

A.- The stamp paper has to be purchased in your name. So you must carry a valid ID proof while purchasing the stamp because the vendor will ask you to show him for name verification.


Q.- What is the duration of the Service Agreement / How long is service agreement ?

A.- The duration of the Service Agreement is two years.


Q.- How many sureties should sign service agreement ?

A.- The agreement has to be signed by only one surety.


Q.- Who can be a Surety ?

A.- A Surety can either be an individual who is an Income Tax payee/ possesses landed property or any individual including parents & relatives who is known to you. A retired employee filing an Income Tax Return & possessing a pan card can also be a surety.


Q.- What are documents submitted by surety along with service agreement ?

A.- In case the surety is an Income tax payee, then the original or attested photo copy of the latest Form 16 (for salaried individuals) else Form 2 D (for self-employed individuals) / IT Returns (acknowledged copy of latest IT Assessment order should be submitted) 
 In case your  surety is an Agriculturist  Original/attested photocopy of the Land Deed or Land Passbook along with a recent valuation certificate of the property (in English only) from the competent authority(civil authorities, architect, tehsildar), duly signed and sealed should be submitted.  The present market estimate of the property should not be less than `50,000.


Q.- What if the valuation certificate is not in english ?

A.- You will have to translate the certificate in English and make an affidavit of the English document. However both the documents, that is. The original valuation certificate (non English) and the affidavit have to be submitted.


Q.- If you are unable to arrange surety ?

A.- In case you are not able to arrange a surety, submit a Fixed Deposit (FD) in your name, for an amount of ` 50,000/- deposited in any of the nationalised banks. The FD should Assigned to  /lien noted to 'Tata Consultancy Services Ltd'. The FD certificate has to be submitted on the day of joining ILP. The FD reciept will be returned to the candidate after completion of two years of service with TCS.

Q.- Should the service agreement be notarised ?

A.- No. The service agreement need not be notarised.


Q.- Do I need original documents of surety ?

A.- No. Only the attested(attested by Gazetted officer.) copies of the surety's documents are needed.


Q.- If surety's signature are different in PAN card and other documents ?

A.- Ensure that the signatures of the Surety affixed on the Service Agreement, Surety Verification form, Passport and other supporting documents (IT returns/PAN card) match. If there  is any mismatch ,surety should make an affidavit  with specimen signatures on ` 100/- stamp paper from a Notary,  mentioning that the signatures are of the same individual.


Q.- Is there any age limit for surety ?

A.- No. As long as the surety conforms to the requirements of being a surety, any person can be a surety.


Q.- If surety is income tax payee and a self employed person, who should do the sign verification of surety verification form ?

A.- Surety verification can be done by the Bank Manager of the bank where the surety holds an account. Alternatively, a copy of the surety's passport may also be attached.


Q.- In service agreement where should the surety sign ?

A.- The surety’s signature should be present at the bottom of all pages of the service agreement. On the last page of the service agreement the surety’s signature should be present at the designated place.
